Srinagar, Feb 23: In illegally occupied Jammu and Kashmir in India, a petition has been filed before the High Court challenging the constitutional justification of Section 18, Jammu and Kashmir Public Safety Act, 1978. I have set a maximum period of precautionary detention permitted under the Act.

 A lawyer, Mustafa MH, has pleaded that after repealing Article 370, Article 18 faces Article 22 (7) of the Constitution, which has not yet been applied to IIOJK.

“In cases of preventive detention, the maximum term of imprisonment should be in accordance with Article 22 (7) of the Constitution of India. Section 18 of the Public Safety Act, 1978 is a violation of Article 22 (7) of the Constitution of India,” the petition said. I have been told.

A bench of Justices Dheeraj Singh Thakur and Javed Iqbal Wani sought reply from the authorities on the petition after hearing the petitioner’s counsel Zulkar Nain Sheikh & Associates.
